1. Acceptance of Terms

By accessing or using Misenpai ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Eligibility

You must be at least 18 years of age to use this Service. By registering, you confirm that you meet this age requirement. We reserve the right to terminate accounts that violate this requirement.

3. Account Registration

4. AI-Generated Content Disclaimer

Misenpai uses artificial intelligence to generate character interactions, dialogue, and content. All AI-generated content is fictional and does not represent the views, opinions, or advice of Misenpai or its operators. You acknowledge that:

• AI characters are not real people and their responses are algorithmically generated.
• AI-generated content should not be taken as professional advice (medical, legal, financial, or otherwise).
• The Service is intended for entertainment purposes only.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to exploit, harm, or harass other users.
• Reverse-engineer, decompile, or attempt to extract source code from the Service.
• Use automated tools, bots, or scrapers to access the Service.
• Impersonate any person or entity, or misrepresent your affiliation.
• Upload or transmit malware, viruses, or other harmful code.

6. User Content

You retain ownership of content you create on the platform (e.g., profile information, comments). By posting content, you grant Misenpai a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Service.

7. Intellectual Property

All content, designs, graphics, AI models, and software associated with the Service are the intellectual property of Misenpai and its licensors. You may not copy, modify, or distribute any part of the Service without prior written consent.

8. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, including for violations of these Terms. Upon termination, your right to use the Service ceases immediately.

9. Limitation of Liability

To the maximum extent permitted by law, Misenpai and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service. The Service is provided "as is" without warranties of any kind.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify users of significant changes via email or in-app notification.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts in Germany.
